Notice of Proposed New Fee

In accordance with A.R.S. §9-499.15, notice is hereby given on May 9, 2025, that the Show Low City Council will consider adopting a new fee for Holdover Rent for Commercial Leases and Operating Agreements at Show Low Regional Airport on July 15, 2025, at 7:00 p.m. in the Show Low Council Chambers located at 181 N. 9th Street in Show Low, Arizona.

 Background

Due to a commercial lessee failing to timely vacate an airport premises upon expiration of their lease, the hardship the delay caused the new lessee, loss of rents and the lack of penalties contained in the lease agreement, the City seeks to impose a Holdover fee in the Commercial Leases and Operating Agreements at Show Low Regional Airport. The City proposes a new fee requiring a lessee who remains in possession of the premises beyond the lease expiration date to pay Holdover Rent, calculated at twice the monthly rent specified in this lease agreement. The Holdover Rent will be due and payable on the same terms and conditions as regular rent. The Holdover Rent will be due and payable on the same terms and conditions as regular rent.

The new fee will be imposed pursuant to Section 2.35.010 of the Show Low City Code. If passed, the new fee will be effective August 14, 2025.
