Is an attorney required for the hearing?: No, an attorney is not required. However, you may bring your attorney, if you wish. The hearing process is informal and rather brief. A Post Impound Hearing can only be requested by the registered owner, the owner’s spouse, or the lien holder.

Vehicle Impoundments Under ARS §28-871

1. Do I need to have a Post Impound Hearing?: You are entitled to a hearing to determine the validity of the impoundment, but a hearing is not required. If you do not want a hearing, you may go directly to the towing company lot, pay the towing and storage fees, and claim your vehicle.

2. When must I request a hearing?: A request for a Post Impound Hearing must be received by the Show Low Police Department within 10 days from the date of the vehicle impoundment. If your request is received after the 10-day period, we will not grant you a hearing on this matter.

3. How is the hearing conducted?: Post Impound Hearings are conducted by staff in the Vehicle Impound Unit of the Show Low Police Department. Hearings are generally held over the telephone.

4. What will I have to prove in a hearing?: You must show why the vehicle should not have been impounded by the Show Low Police Department. If you have any documentation, it must be provided to the hearing officer prior to or at the hearing.

5. Is there a charge to have a hearing?: No, there is no fee or charge for a hearing.
